These Terms & Conditions (hereinafter: "Terms") govern the use of the website nexviloq.com and services provided by Nexviloq d.o.o. By using our platform, you accept these Terms in their entirety.
1. General provisions
Nexviloq d.o.o. is a company registered in the Republic of Croatia, with registered office at Ilica 42, 10000 Zagreb, entered in the Commercial Register of the Commercial Court in Zagreb under company registration number (MBS): 081234567, OIB: 12345678901. The company operates under the license of the Croatian Financial Services Supervisory Agency (HANFA).
2. Service description
Nexviloq provides a digital platform for real estate crowdfunding that enables users to participate in financing construction projects in the Republic of Croatia. The platform serves as an intermediary between project developers and investors, providing transparent information about projects, investment terms, and work progress.
3. Participation requirements
To use the platform's services, you must be: an adult natural person (18+ years) with residence in the Republic of Croatia or another EU/EEA country, or a legal entity registered in accordance with applicable regulations. Users are required to provide accurate and up-to-date information during registration and to promptly update their information in case of any changes.
4. Investment risks
Investing in real estate through crowdfunding involves certain risks: possible loss of part or all of the invested amount, delays in project completion, changes in market conditions that may affect expected returns, liquidity risk as funds may be tied to the project duration. Nexviloq does not guarantee profit or return of invested funds. Each investor is obligated to independently assess risks before making an investment decision.
5. User obligations
Users agree to: use the platform in accordance with these Terms and applicable laws, not use the platform for money laundering or terrorist financing, maintain the confidentiality of their access credentials, not disrupt platform operations or attempt unauthorized access to systems.
6. Intellectual property
All content on the website nexviloq.com, including texts, graphics, logos, icons, images, audio and video materials, software, and databases, is the property of Nexviloq d.o.o. or is used under appropriate licenses. Copying, distribution, or public display of content without prior written permission is prohibited.
7. Limitation of liability
Nexviloq d.o.o. is not responsible for: losses resulting from investments through the platform, interruptions in platform availability caused by technical issues or maintenance, actions of third parties beyond our control, accuracy of information provided by project developers. Our liability is limited to the amount of fees you have paid for using the platform in the last 12 months.
8. Termination and suspension
We reserve the right to suspend or permanently disable platform access for users who violate these Terms, provide false information, use the platform for illegal activities, or disrupt platform operations. In case of termination, obligations from existing investments remain in force.
9. Governing law and dispute resolution
These Terms are interpreted and applied in accordance with the laws of the Republic of Croatia. For all disputes arising from these Terms or use of the platform, the competent court in Zagreb shall have jurisdiction. Before initiating court proceedings, parties will endeavor to resolve disputes amicably.
10. Amendments to terms
Nexviloq d.o.o. reserves the right to amend these Terms at any time. Users will be notified of all significant changes via email or platform notification at least 30 days before the changes take effect. Continued use of the platform after publication of amended Terms constitutes acceptance thereof.
